Terms and Conditions of Service of Fiestify

1. Introduction
These Terms and Conditions regulate the use of the Fiestify online store, whose company name is Unboxed Joy, S.L., with registered office in Barcelona, Spain, Carrer de Calders 4, 08003 Barcelona and NIF B22616239. By placing an order through our website, you fully accept these conditions, so we recommend that you read them carefully before using the site or purchasing any product.

2. Purpose of the contract
Fiestify acts as an intermediary in the sale of products through a dropshipping model in collaboration with one or more external suppliers, who are responsible for the preparation, logistics, and shipping of the products to the customer. Fiestify does not manufacture or store the products.

3. Purchase process
To make a purchase, you must select the desired products, add them to the cart, and complete the form with your personal data and shipping address. During the process, the total costs, including taxes and shipping fees, will be displayed. Acceptance of the order constitutes the formation of the sales contract between you and Fiestify.

4. Payment methods
Fiestify offers various secure payment methods, such as credit/debit card, PayPal, and others indicated on the website. Payment is made at the time of confirming the order. Bank and payment data are managed through specialized external platforms to ensure maximum security and privacy.

5. Shipping and delivery times
Shipments are carried out by BigBuy, in accordance with the conditions detailed in the Shipping Policy. The estimated delivery times are 2 to 4 business days, which may vary depending on the product and destination. Fiestify is not responsible for delays, losses, or incidents during transport, which must be managed through our customer service.

6. Prices and taxes
All prices shown include the legally applicable VAT in Spain. No hidden additional costs will apply, and shipping fees are clearly specified during the purchase process.

7. Cancellations and modifications
You may request the cancellation or modification of an order as long as it has not yet been processed for shipment by one or more of our external suppliers. Once the order is in process or has been shipped, it cannot be modified or canceled.

8. Returns and refunds
The conditions for returns and refunds are regulated according to the Returns Policy. Returns are only accepted for defective products, damages, or errors in the order. Returns due to a change of mind are not allowed. The process will be managed in coordination with our external suppliers.

9. Liability and limitation of liability
Fiestify acts solely as an intermediary in the marketing and sale of products supplied by our external suppliers under the dropshipping model. We are not responsible for and assume no liability for defects, damages, delays, losses, breaches, manufacturing defects, or any other incident related to the products, their quality, characteristics, or the shipping and delivery process, as these aspects are the exclusive responsibility of our suppliers and the carriers in charge.
In no event shall Fiestify be liable for direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the products, nor for any economic or other loss that may arise.
Fiestify’s responsibility is strictly limited to the management and processing of orders and claims with external suppliers, without this implying any assumption of risks or additional guarantees regarding the products or services provided by third parties.
In accordance with Regulation (EU) 524/2013, we inform you of the existence of the European online dispute resolution platform, which can be accessed at https://ec.europa.eu/consumers/odr/

10. Intellectual property
The website contents, including texts, images, logos, and designs, are the property of Fiestify or third parties who have authorized their use. Reproduction, distribution, or unauthorized use without express consent is prohibited.

11. Data protection
Your personal data will be processed in accordance with our Privacy Policy, complying with the General Data Protection Regulation (GDPR) and other applicable regulations.

12. Applicable law and jurisdiction
These terms are governed by Spanish law. Any disputes will be submitted to the courts and tribunals of Barcelona, unless applicable law provides otherwise.

13. Right of withdrawal
The customer has the right to withdraw from this contract within 14 calendar days without the need for justification, in accordance with Article 102 of Royal Legislative Decree 1/2007. To exercise the right of withdrawal, the customer must notify their decision through an unequivocal statement (for example, a letter sent by email).
This right will not apply in cases excluded by law, such as personalized products or products that, for hygiene reasons, cannot be returned.
